Title Centrally sponsored scheme of implementation of the Scheduled Castes / Scheduled Tribes (Prevention of Atrocities) Act, 1989 - Providing relief and rehabilitation to Scheduled Caste / Scheduled Tribe victims of atrocities or their dependants.
Introduction In order to check and deter crimes against Scheduled Caste/ Scheduled Tribes by persons belonging to other communities, the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989 was brought in to force from 30/01/1990. The prevention of Atrocities Act defines certain categories of offences against Scheduled Castes and Scheduled Tribes as "atrocities" for the purpose of the Act. Comprehensive rules were also notified under this Act in 1995 which lay down norms for relief and rehabilitation, among other things. Under the centrally sponsored scheme of "Implementation of Prevention of Atrocities Act- 1989", Central Assistance is released by Govt. of India on 50:50 basis to provide relief and rehabilitation to the victims /dependants of atrocities
Scheme Providing relief and rehabilitation to the victims / dependants of atrocities.
Description Under the Prevention of Atrocities Act, the State Govt. is required to undertake various measures which include
  1. Provision of adequate facilities including legal aid
  2. Traveling and maintenance expenses to victims and witnesses
  3. Appointment of officers for initiating and exercising supervision over prosecutions
  4. Setting up of committees at different levels for formulation or implementation of such measures
  5. Periodic survey of the working of the Act with a view to suggesting measures for better implementation
  6. Identification of atrocity prone areas and adoption of measures to ensure the safety of Scheduled Castes / Scheduled Tribes in such areas
  7. Relief and rehabilitation to victims / dependants of atrocities.
  8. 1.     Relief and rehabilitation of victims of atrocities includes:               

    2.     a) Amount of compensation ranging from Rs.25,000 to 2 lakh rupees, depending upon, the nature of the offences.

    b) Pension to each widow and /or other dependents of the deceased SC/ST at Rs.1000/-pm or employment to one member of the family of the deceased /or provision of Agricultural land, a house if necessary by outright purchase.

    c) Full cost of the Education and maintenance of the children of the victims. The children may be admitted to Ashram schools/ residential schools of the Department.

          d) Provision of utensils, and provisions for a period of 3 months.

          e) Construction of Brick/stone masonry house at Government cost, if the house has been burnt or destroyed.

     Apart from relief & rehabilitation to the Atrocity victims; depending upon the nature of the offences the persons who commit these atrocities shall be punishable with imprisonments for a term, which shall not be less than 6 months, but which may extend to 5 years and with a fine of Rs.100- Rs.500.

    In some cases the person or persons who commits any offences under the Indian Penal Code, punishable with imprisonment for a term of 10 years or more, against a person or property on the ground that such person is member of SC/ST belonging to SC/ST or such property belongs to such member shall be punishable with imprisonment for life and with fine.
Eligibility Any Scheduled Caste / Scheduled Tribe victim / dependant of atrocity.
